COVID-19 Essential variations
In order to conform with the current government requirements for social distancing in the light of the COVID-19 pandemic, DriveTech are revising the police referred course delivery to online/remote access from attendance at a physical venue in the UK. This change is authorised by Police Forces in the light of current unprecedented circumstances. These terms and conditions have therefore been amended to reflect this important change to the mechanism of course delivery until further notice.
1.1 ‘You’ – refer to you, the customer, the person this letter is addressed to.
1.2 ‘We’ and ‘Us’ and ‘Our’ - refer to the DriverAware Division, DriveTech (trading name of DriveTech (UK) Limited).
1.3 ‘Scheme’ - an offer by the Police to complete an educational driver training programme rather than a fine, penalty points or prosecution.
1.4 ‘Course’ – the particular training course or workshop we run under the Scheme.
1.5 ‘Booking Period’ – a period of 21 calendar days from the date of our invite letter to you.
1.6 ‘Critical Date’ – the date the Police give by which you must complete your course. This is also known as the ‘expiry date’ or ‘completion date’.
1.7 ‘Standard Booking’ – a booking for a course for which the rescheduling fees under clauses 5.1 and 5.2 apply.
1.8 ‘Flexible Booking’ – a booking for a course including the ability to reschedule your booking free of charge up until 6 p.m. the evening before your course is scheduled to take place.
2.1 Booking: You must book and pay for your course within the booking period. You must complete the course by the critical date. If you cannot complete your course by this deadline, you will not be able to do the course and the Police will consider prosecuting you for the offence.
2.2 Standard and Flexible bookings: Rescheduling fees apply for Standard bookings as detailed in section 5.0. A Flexible booking is available at a fee of £5.00 plus full course fee at time of booking. This allows you to reschedule your course with us free of rescheduling fees up until 6 p.m. the evening before your course is scheduled to take place. Every effort will be made to accommodate your preferred choice of venue in this event. Please note that any rescheduled course must be within your critical date. Payment by instalments is not available for Flexible bookings.
2.3 Specific requirements: Please tell us at the time of booking about any specific requirements (for example impairment, disability and/or access issues, the requirement to breastfeed or the need to take an interpreter) that you want us to consider so that we can make suitable arrangements. Please note, we do not provide foreign language interpreters, however, you are welcome to bring a friend or family member to the course to translate for you, providing we have been informed in advance and they are 16 years of age or older.
2.4 Failure to book: If you fail to book a place within the booking period you may not be eligible to go on the scheme and the Police will consider prosecuting you for the offence.
3.0 Payment: You can pay using most debit and credit cards. Once you have booked and paid for your course, your booking and any payment made is non-transferable and non-refundable - If you do not make the payment, you will not be able to attend the course.
4.1 Completing the course:
From the 25th of March 2020 until further advised by our governing authorities, due to the COVID-19 crisis, courses will be run online in a virtual classroom environment. To access the course all attendees must have a device with a front facing camera, a microphone and device sound, access to Microsoft Teams (free to download as an app) and a strong internet connection (broadband recommended). Please be aware that the camera will be able to see behind you and you will be required to login from a quiet place at home where you will be uninterrupted.
Please Note – when joining your course via Microsoft teams you will be invited to choose a preferred name, giving you the option to amend any personal details you may prefer to remain confidential. Type your name (first name only is preferable) but make sure you use a name that you are happy for others to see on screen and the trainers to use. Please be aware that if you already have a Teams account your username will be visible to other attendees – you should therefore log out and re-join as a guest where you can choose which name to display. If you are using a private Teams account, you may be able to edit your visible name in settings.
The online, interactive course will last around 2.5 hours rather than the previously stated 3 hours for a venue attendance. You must satisfactorily complete the course. This involves attending online on time, being present for the entire duration and fully taking part. The trainer will decide if you have completed the course. When you participate on the course, you cannot have anyone else with you (unless it is necessary in order to meet a specific requirement as per clause 2.3 or as otherwise agreed beforehand with us) or have pets or other unreasonable distractions.
5.1 Rescheduling your Standard booking more than 14 days before your original course date: If you reschedule with more than 14 days before the original course date you will be required to pay a rescheduling fee of £25.00. Original booking clauses apply. Not applicable for Flexible bookings.
5.2 Rescheduling your Standard booking less than 14 days before your original course date: If you reschedule with less than 14 days before the original course you will be required to pay the full course fee again. Original booking clauses apply. Not applicable for Flexible bookings.
6.1 Exceptional circumstances: For example, bereavement, medical reasons or you are a parent or carer and your dependant is taken ill, you will be able to reschedule your course by calling our Client Services Team.
6.2 Any other reason: You may book another course, if one is available and pay a full course fee as described in clause 5.2.
7.1 Failure to complete: You will fail to complete your course:
7.2 If you arrive late: You will not be allowed on to the course if you arrive after the course start time. You may still have the opportunity to reschedule your course but you will have to pay the full course fee. If you fail to attempt to make a new booking your file will be returned to the Police.
7.3 Personal identification: When you attend your online course, you must produce suitable photographic identification for example driving licence or passport. This will require you to make available your ID to the camera on your active device to allow the remote trainer to view and log your details. If you do not have photographic ID, you must provide two separate forms of identification, for example an original utility bill (gas, electricity or home phone) or council tax bill or a bank or credit card statement that we can match with your details given to us by the Police. If you fail to establish your identity satisfactorily you will not be allowed to participate on the course. You may still have the opportunity to reschedule your course but you will have to pay the full course fee again. If you fail to attempt to make a new booking your file will be returned to the Police.
7.4 Unfit to take part: You must be in a fit state to participate fully in the course. Any evidence of you being unfit to take part will result in removal from the course. In these instances you will not be able to reschedule and your file will be returned to the Police.
7.5 Abusive, disruptive or fail to take part fully: If, in the opinion of the trainer, you are abusive and/or disruptive or you fail to participate during the course we will ask you to leave the live ‘online classroom’.
8.1 Cancelling: For both Standard and Flexible bookings, you have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day that you made your booking. Please note that if you book a course date to take place within this 14 day period your right to cancel and obtain a full refund shall cease on the day you are due to take the course. To claim your refund please contact our customer care team. By choosing this option your file will be returned to the police.
8.2 If we cancel the course: If we cannot deliver your course for any reason outside of our control, we will make every effort to contact you via text or email message advising you of any disruption or cancellation. Once the course is cancelled you must contact us to reschedule as soon after the course date as possible. The Police are at liberty to withdraw the offer of a course at any time after the original course date. You will not have to pay any extra charge to reschedule. If you do not wish to reschedule your course then we will provide a full refund on application through our Customer Care Team.
9.0 Liability and Data Security
We will not be liable under these terms and conditions for any loss or damage caused by us or our employees or agents in circumstances where:
i) There is no breach of a legal duty of care owed to you by us or by any of our employees or agents; and
ii) Such loss or damage is not a reasonably foreseeable result of any such breach.
iii) Your personal data will only be used for purposes in relation to operating the scheme. For full details of our privacy notice please refer to our website www.drivetech.co.uk
We shall also not be liable for any increase in loss or damage resulting from breach by you of any term of this contract. Nothing in this contract of sale will affect your statutory rights or in any way exclude or limit our liability to you for death or personal injury resulting from our negligence.
