1.0 Definitions

1.1 ‘You’ – refer to you, the customer.

1.2 ‘We’ and ‘Us’ and ‘Our’ – refer to the Police Division, Drivetech (trading name of Drivetech (UK) Limited).

1.3 ‘Course’ – the training course you need to book/attend. This could be either a virtual course (“Virtual Course”) or a classroom-based course (“Classroom Course”).

1.4 ‘Booking Period’ – a period set by the Police in which you need to book.

1.5 ‘Critical Date’ – the date set by the Police by which you must complete your Course.

1.6 ‘Standard Booking’ – a booking for a Course for which the rescheduling fees under clauses 5.1 and 5.2 apply.

1.7 ‘Flexible Booking’ – a booking for a Course which includes the ability to reschedule your Course date free of charge. Please see clause 5.2 for full details.

1.8 ‘Police’ – the relevant police force that issued you with the Notice of Intended Prosecution following the driving offence.

1.9 ‘Police Central Cost Recovery Element’ – the fee paid to the Police and UKROEd by Drivetech for administering the referral, this is £49 + VAT, with the exception of a Safe & Considerate Driving Course to be attended in Northern Ireland which is £4 +VAT

2.0 Booking

Contact Us, Booking and Completion

‘Contact Us’ – you can contact us by phone on 0344 264 6323, Monday to Friday 07:30 – 18:00, Saturday and Sunday 08:00 – 15:00, closed on Public and Bank Holidays.

2.1 Booking and completion: 

  • You must book and pay for your Course within the Booking Period. If you fail to book a Course within the Booking Period the Police will consider prosecuting you for the offence.
  • The email address provided to UKROEd during registration, will be used to send details of your booking and any updates. You must contact us if you have not received your course confirmation within 24 hours of payment and immediately if you change your contact details.
  • You must complete the Course by the Critical Date. If you do not complete your Course by the Critical Date, the Police will consider prosecuting you for the offence.

2.2 Specific requirements: Please Contact Us at the time of booking about any specific requirements (i.e. disability and/or access issues, the requirement to breastfeed or the need to have an interpreter present) that you want us to consider so that we can make reasonable adjustments for you.

 

 

2.2.1 Interpreters:

  • Courses with British Sign Language interpreters can be made available. Please email frontlinetechteam@drivetech.co.uk for more information.
  • We do not provide foreign language interpreters, but you can arrange to have an interpreter or a friend or family member present to translate for you if they are at least 16 years old. You must Contact us to supply the interpreter’s name before the day of the Course, and they will need to have identification available on the day of the Course.
  • If you are attending a Virtual Course, you will need to turn off your microphone when having content translated to avoid disruption for other customers and the trainer. You must turn your microphone back on when taking part in the Course. Your interpreter can give your answers for you.

2.2.2 Breastfeeding: 

  • Please Contact Us in advance of your Course to discuss your requirements and to allow us to make appropriate arrangements.
  • Please note that any arrangements must also take into consideration the interests of everyone on the course, and you must attend the whole of the course in order to achieve completion. We recommend having childcare available to enable you to continue with the course if the child becomes unsettled.
  • Classroom Course: Whilst you are not permitted to breastfeed, express milk, or bring a baby into a physical Classroom Course, we will make available a private area for you to feed your baby or express milk.
  • Virtual Course: You can be offered the opportunity to breastfeed during a virtual course.  Please be aware of the need to be able to show only your facial profile on the screen and to mute your microphone if necessary.

3.0 Payment

3.1 Payment: You can pay using most debit and credit cards. If you do not make the payment at the time of booking, or if paying by instalments in accordance with the timeframes described in clause 3.2, you will not be able to attend the Course.

3.2 Instalments: You can set up a payment plan using no more than 3 instalments, please Contact Us for this option. An initial minimum payment of £25.00 is required. All outstanding fees must be paid at least 14 days prior to your Course date. If you choose to pay by instalments and fail to clear all outstanding fees at least 14 days prior to your Course date, your course will automatically be cancelled.

4.0 Attendance

Attendance and Course requirements

4.1 Course requirements: Failure to comply with the Course requirements may result in your exclusion from the Course and you may not achieve completion of the Course.  The trainer will decide if you have met the Course requirements and have completed the Course.

 

4.2 Identification:

  • You and any interpreter must bring appropriate identification with you to a Course, for example a photographic driving licence or passport. you must have the original documents. Photocopies or copies of a driving licence or passport recorded on a mobile phone will not be accepted. 
  • You must show your photographic identification on request to the trainer to register for the course.
  • If you do not have photographic identification, please Contact Us prior to the Course.
  • If you fail to establish your identity satisfactorily you will not be allowed to participate in the Course and will need to reschedule (which may be subject to a rescheduling fee).
  • If you are attending a Safe & Considerate Driving course with an on-road element, you must produce your driving licence (and counterpart if in Northern Ireland).

4.3 Completing the Course: You must participate satisfactorily to complete the Course. This involves attending on time, being present for the entire duration of the Course and participating fully.

  • Classroom Course: You must bring a pen or pencil.

 

  • Virtual Course:
    • For the entire duration of the Course, you must be completely alone, unless you need someone with you in order to meet a specific requirement as per clause 2.2 or as otherwise agreed beforehand with us.
    • You must be in a private location. You must not be interrupted for the duration of the Course. Your location must be quiet as any background noise or activity can disturb other customers and the trainer. If your location is deemed inappropriate by the trainer you may be removed from the Course.
    • You must have a device with a front facing camera, a microphone and device sound, access to Microsoft Teams (free to download as an app or available on a web browser) and a strong and sufficient internet connection.Please be aware that the camera will be able to see behind you, and that virtual or blurred backgrounds are not permitted on Virtual Courses.  Please also have with you a pen or pencil and some paper.

 

  • Safe & Considerate Driving Course with an on-road element: As the course involves practical driving on a public road you will be unable to attend if you do not produce a valid and in-date driving licence. You must produce either your photocard licence or a paper licence and suitable photographic identification (e.g., passport). For Northern Ireland licences, you will need your counterpart as well as your photocard licence. If you cannot produce a licence, (for licences issued by the DVLA only) you may produce a passport and a valid check code along with your driving licence number. Visit https://www.gov.uk/view-driving-licence, check codes are only valid for 21 days and can only be used once. You must be able to read (with glasses or contact lenses, if necessary) a car number plate from the legally required distance. Suitable clothing and footwear should be worn; these should not prevent you using the controls in the correct manner.

4.4 Mobile communications: With the exception of a device being used to participate in a Virtual Course, use of mobile communication devices is strictly forbidden. Any other mobile communication devices, including mobile phones, tablets, or computers in the vicinity and/or room must be switched off, or to ‘Do Not Disturb’, ‘Meeting’ or ‘Silent’ modes and stored out of sight. The vibrate function should be turned off to minimise disruption. This requirement will include smart watches or other connected devices, alarms, and notifications.

4.5 Standards and behaviour during the course: Maintaining a comfortable environment in which all Course attendees can participate is important. Customers participating on Courses should conduct themselves in a respectful manner to the trainers and other customers attending. Disruptive behaviour, intoxication, non-compliance, or misbehaviour whilst on a Course is unacceptable. 

To protect everyone’s privacy, you must not take any screen shots, photographs, or recordings of the course.  UKROEd actively monitor all social media channels and if a data breach is discovered this will be fully investigated.  This may lead to your Course attendance being void and you may be referred back to the Police.

4.6 Unfit to take part: You must be in a fit state to participate in the course. Any evidence of your being unfit to participate satisfactorily will result in removal from the Course. Following such event, you may not be able to reschedule the Course, and you may be referred back to the Police. You will not be eligible for any refund.

4.7 Abusive or disruptive behaviour, or failure to participate fully: If you are abusive and/or disruptive or you fail to participate fully during the Course the trainer may ask you to leave. In these instances, you may not be able to reschedule, and you may be referred back to the Police. You will not be eligible for any refund.

5.0 Rescheduling

5.1 Standard Booking: Rescheduling your Standard booking more than 14 days before your original Course date: If you reschedule with more than 14 days before your Course date you will be required to pay a rescheduling fee of between £25.00 and £32.00, this will depend on the police force area of the new course.

Rescheduling your Standard booking less than 14 days before your original course date: If you reschedule with less than 14 days before your Course you will be required to pay the full course fee minus the police central cost recovery element of £49 +VAT or if rescheduling a Safe & Considerate Driving Course in Northern Ireland, of £4 +VAT.

5.2 Flexible Booking: Flexible booking is available for a fee of £5 on booking. This allows you to reschedule free of charge as many times as needed up until 6pm the day before your course either at courses.drivetech.co.uk/  or you can Contact Us. Subject to availability prior to your deadline.

Flexible booking is not availble for the Safe & Considerate Driving Course, or when paying by instalments.

5.3 Instalment Payments: Rescheduling fees as per clause 5.1will apply and you will be expected to clear the outstanding balance on the existing or cancelled booking before rescheduling. If you clear all outstanding fees and fail to complete your course, terms regarding rescheduling and attendance will apply.

5.4 Transferring to Another ‘National Driver Offender Retraining Scheme (NDORS) Course’: We operate a number of NDORS courses across the country for different police forces. If you want to transfer between the NDORS courses that we operate, the provisions and the rescheduling fee in clauses 5.1 or 5.2 will apply. If you choose to transfer to a higher priced Course that we operate, you will need to pay the difference in fees between the two Courses, as well as the rescheduling fee. You will not be entitled to any refund if you choose to transfer to a lower priced Course. Applicable to both Flexible and Standard bookings.

6.0 Non-attendance

6.1 Exceptional circumstances: If you are unable to attend a course due to exceptional circumstances, for example, bereavement, medical reasons, or you are a parent or carer and your dependant is taken ill, you may be able to reschedule your course, please Contact Us as soon as possible to avoid the risk of your course offer being withdrawn by the police.

6.2 Any other reason: If you do not attend your Course, you may book another Course, if one is available.  You will be required to pay a full Course fee (minus the police central cost recovery element).

7.0 Non-completion

7.1 Failure to complete: If you fail to complete your Course, please Contact Us to discuss your options. Please note without a live booking in place your offer to complete a Course is at risk of being withdrawn by the Police.

7.2 If you arrive late:  You will not be allowed on to the Course if you arrive after the Course start time. You may still have the opportunity to reschedule your Course, but you will have to pay any applicable rescheduling fee.

8.0 Cancelling

8.1 Cancelling: For both Standard and Flexible bookings, you have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day that you made your booking. Please note that if you book a Course date to take place within this 14 day period you may cancel and obtain a full refund up to the Course start, after which time you will only be entitled to a refund of £49 +VAT or if cancelling a Safe & Considerate Driving course in Northern Ireland of £4 +VAT, the police central cost recovery element. 8.2 Cancellation without rescheduling with us: If you cancel your Course after the period of 14 days of making your initial booking and choose not to reschedule with us, we will provide a refund of £49 +VAT or if cancelling a Safe & Considerate Driving course in Northern Ireland of £4 +VAT, the police central cost recovery element (provided a full course payment has been made). To claim your refund please Contact Us. Applicable to both Standard and Flexible bookings.

8.3 If we cancel the course: If we cannot deliver your Course for any reason, we will make reasonable efforts to contact you via SMS text message or email advising you of any disruption or cancellation. Once the Course is cancelled you must contact us to reschedule as soon as possible. The police are at liberty to withdraw the offer of a Course at any time after the original Course date. You will not have to pay any extra fee to reschedule in such circumstances. If you do not wish to reschedule your Course, please Contact Us and we will provide a full refund on application.

9.0 Driving Licence

If you have surrendered your driving licence you may still be able to attend the course, please see clause 4.2 for information.

 

10.0 Liability and Data Security

Privacy Notice 

Drivetech (UK) Limited will process your personal data, to provide the educational services which have been offered to you by the Police. Personal data will include details about you, such as your full name, date of birth and gender, as well as contact details and information about your health, if you are a vulnerable customer. You have a number of rights under UK data protection laws. You have the right to be informed about the processing of your personal information; to have your personal information corrected; to object to processing; to request restriction of processing; to have your personal information erased; to request access to your personal information and how we process it; to move, copy or transfer your personal information; and rights in relation to automated decision making which has a legal effect or otherwise significantly affects you.  They don’t apply in all circumstances so if you wish to use any of them, we’ll explain at that time if they apply or not.

Liability

We will not be liable under these terms and conditions for any loss or damage caused by us or our employees or agents in circumstances where:

  1. Such loss or damage is not a reasonably foreseeable result of any such breach, or
  2. Such loss or damage is in connection to a business, trade, craft or profession.

 

Nothing in this contract of sale will affect your statutory rights.
