Terms & conditions National

VERY IMPORTANT: By booking a place on the Scheme with us, you agree to be bound by these terms & conditions. Other service providers nationally may offer different terms & conditions.

1.0 Definitions 

1.1 ‘You’ – refer to you, the customer, the person this letter is addressed to.

1.2 ‘We’ and ‘Us’ and ‘Our’ - refer to the Police Division, DriveTech (trading name of DriveTech (UK) Limited).

1.3 ‘Course’ – the particular training course you need to book/attend.

1.4 ‘Booking Period’ – a period set by the Police in which you need to book.

1.5 ‘Critical Date’ – the date the Police give by which you must complete your course. This is also known as the ‘expiry date’ or ‘completion date’.

1.6 ‘Standard Booking’ – a booking for a course for which the rescheduling fees under clauses 5.1 and 5.2 apply.

1.7 ‘Flexible Booking’ – a booking for a course including the ability to reschedule your booking free of charge. Please see clause 2.2 for full details.

2.0 Booking 

2.1 Booking: You must book and pay for your course within the booking period. You must complete the course by the critical date. If you cannot complete your course by this deadline, you will not be able to do the course and the Police will consider prosecuting you for the offence.

2.2 Standard and Flexible bookings: Rescheduling fees apply for Standard bookings as detailed in section 5.0. A Flexible booking is available at a fee of £5.00 plus full course fee at time of booking. This allows you to reschedule free of charge up until 6 pm the evening before your course. If rescheduling by telephone our contact centre closes at 3 pm on Saturdays and Sundays. Every effort will be made to accommodate your preferred choice of venue in this event. Please note that any rescheduled course must be within your critical date. Please note the Flexible booking option is not available when paying by instalments.

2.3 Specific requirements: Please tell us at the time of booking about any specific requirements (for example impairment, disability and/or access issues, the requirement to breastfeed or the need to take an interpreter) that you want us to consider so that we can make suitable arrangements. Please note, we do not provide foreign language interpreters, however, you are welcome to bring a friend or family member to the course to translate for you, providing we have been informed in advance and they are 16 years of age or older.

2.4 Failure to book: If you fail to book a place within the booking period the Police will consider prosecuting you for the offence.

3.0 Payment 

3.1 Payment: You can pay using most debit and credit cards, by cheque or by cash. If your course is less than 21 days from the date on which you made your booking, you must pay by debit or credit card. Once you have booked and paid for your course, your booking and any payment made is non-transferable and non-refundable - If you do not make the payment, you will not be able to attend the course.

3.2 Cheques: Your cheque should be made payable to ‘DriveTech (UK) Limited’. We must receive your payment within 10 days from the date of booking to secure your place. If payment is not received within this time your course will automatically be cancelled.

3.3 Cash: In order to pay by cash, you must request this option through our Client Services Team at the time of booking. If you pay by cash, we must receive your payment within 10 days from the date of booking to secure your place. If your cash payment is not received within 10 days from the date of booking, then your course will automatically be cancelled.

3.4 Instalments: You can pay by instalments by setting up a payment plan using no more than 3 instalments, by contacting our Client Services Team. An initial minimum payment of £25.00 is required. All outstanding fees must be paid at least 14 days prior to your course date. If you choose to pay by instalments and fail to clear all outstanding fees by this deadline then your course will automatically be cancelled. Rescheduling fees as per clause 5.2 will apply and you will be expected to clear the outstanding balance on the existing booking before rescheduling. If you clear all outstanding fees and fail to complete your course, then normal terms apply regarding rescheduling and attendance. Instalments are not available for Flexible bookings.

4.0 Attendance 

4.1 Completing the course: You must satisfactorily complete the course. This involves arriving on time, being present for the entire duration and fully taking part. The trainer will decide if you have completed the course. When you attend the course, you cannot take anyone else with you (unless it is necessary in order to meet a specific requirement as per clause 2.3 or as otherwise agreed beforehand with us) or take pets as there are no facilities to accommodate them at the training venues. Electronic cigarettes are not permitted to be used inside of the classroom.

4.2 Mobile communications are strictly forbidden; therefore, any mobile devices must be switched off and out of sight for the duration of the course.

4.3 Standards and behaviour during the course: People attending NDORS courses should conduct themselves in a respectful manner to the course trainers and others attending the course. Disruptive behaviour, intoxication, wilful non-compliance or wilful misbehaviour whilst on a course is unacceptable.
Maintaining a comfortable environment in which all course attendees can participate is important, therefore, course attendees are individually responsible for their personal hygiene and general presentation so no one individual can adversely affect other course attendees with whom the individual comes into contact. Course attendees should not wear clothing which is likely to cause embarrassment or offence to others delivering or attending a course.
Failing to comply with the terms and conditions may result in you being excluded from a course.

5.0 Rescheduling 

5.1 Rescheduling your Standard booking more than 14 days before your original course date: If you reschedule with more than 14 days before the original course date you will be required to pay a rescheduling fee of £25.00. Original booking clauses apply. Not applicable for Flexible bookings.

5.2 Rescheduling your Standard booking less than 14 days before your original course date: If you reschedule with less than 14 days before the original course you will be required to pay the full course fee again minus the police central cost recovery element. Original booking clauses apply. Not applicable for Flexible bookings.

5.3 Transferring to Another ‘National Awareness Course’: We operate a number of National Awareness courses across the country for different police forces. If you want to transfer between the National Awareness courses that we operate, the provisions and the rescheduling fee in clause 5.1 and 5.2 will apply as appropriate in the circumstances. If you choose to transfer to a higher priced course that we operate, you will need to pay the difference in fees between the two courses (as well as the rescheduling fee). You will not be entitled to any refund, if you choose to transfer to a lower priced course. If you choose to transfer to a National Awareness course operated by a different service provider (after making your original booking with us) clause 8.2 shall apply. Applicable to both Flexible and Standard bookings.

6.0 Non-Attendance 

6.1 Exceptional circumstances: For example, bereavement, medical reasons or you are a parent or carer and your dependant is taken ill, you will be able to reschedule your course by calling our Client Services Team.

6.2 Any other reason: You may book another course, if one is available and pay a full course fee as described in clause 5.2.

7.0 Non-Completion 

7.1 Failure to complete: If you fail to complete your course please contact our Client Services Team to discuss your options. Please note without a live booking in place your course offer is at risk of being withdrawn by the Police.

7.2 If you arrive late: As stated in your booking confirmation you will not be allowed on to the course if you arrive after the course start time. You may still have the opportunity to reschedule your course, but you will have to pay the full course fee minus the Police central cost recovery element.

7.3 Personal identification: When you attend your course, you must produce suitable photographic identification for example driving licence or passport. If you do not have photographic ID, you must bring two separate forms of identification, for example an original utility bill (gas, electricity or home phone) or council tax bill or a bank or credit card statement that we can match with your details given to us by the Police. If you fail to establish your identity satisfactorily you will not be allowed entry on to the course. You may still have the opportunity to reschedule your course, but you will have to pay the full course fee again minus the Police central cost recovery element. If you fail to attempt to make a new booking your file will be returned to the Police.

7.4 Safe and Considerate Driving:

i) As the course involves practical driving on a public road you will be unable to attend if you do not have a valid and in-date driving licence. If you only have a paper licence and no photocard then you must also provide alternative and suitable photographic identification (e.g. Passport). All delegates will be asked to sign a disclaimer at registration stating that you are not disqualified from driving or had your licence suspended or revoked. If attending in Northern Ireland you will need your counterpart as well as your photocard licence.

ii) You must be able to read (with glasses or contact lenses, if necessary) a car number plate from the legally required distance.

iii) Suitable clothing and footwear should be worn, these should not prevent you using the controls in the correct manner.

7.5 Unfit to take part: You must be in a fit state to participate fully in the course. Any evidence of you being unfit to take part will result in removal from the course.

7.6 Abusive, disruptive or fail to take part fully: If, in the opinion of the trainer, you are abusive and/or disruptive or you fail to participate during the course we will ask you to leave.

8.0 Cancelling 

8.1 Cancelling: For both Standard and Flexible bookings, you have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day that you made your booking. Please note that if you book a course date to take place within this 14 day period you may cancel and obtain a full refund up until the day before you are due to attend the course, after which time you would only be entitled to a refund of the police central cost recovery element. To claim your refund please contact our Client Services Team.

8.2 Cancellation without rescheduling with us: If you cancel your course outside of the period of 14 calendar days of making your initial booking without rescheduling with us and want to book with another provider or do not reschedule at all then we will provide a refund of the police central cost recovery element providing a full course payment has been made. Our Client Services Team will talk you through the refund. Applicable to both Standard and Flexible bookings.

8.3 If we cancel the course: If we cannot deliver your course for any reason outside of our control, we will make every effort to contact you via text or email message advising you of any disruption or cancellation. Once the course is cancelled you must contact us to reschedule as soon after the course date as possible. The Police are at liberty to withdraw the offer of a course at any time after the original course date. You will not have to pay any extra charge to reschedule. If you do not wish to reschedule your course, then we will provide a full refund on application through our Client Services Team.

9.0 Driving Licence 

9.0 Where you have surrendered your driving licence, it will be held by the Police for the period from surrender to successful completion of the Course or your request for a court appearance or payment of fixed penalty fine when it will be automatically returned to you by post to the address provided on the offer acceptance form.

10.0 Liability and Data Security 

We will not be liable under these terms and conditions for any loss or damage caused by us or our employees or agents in circumstances where:
i) There is no breach of a legal duty of care owed to you by us or by any of our employees or agents; and
ii) Such loss or damage is not a reasonably foreseeable result of any such breach.

We shall also not be liable for any increase in loss or damage resulting from breach by you of any term of this contract. Nothing in this contract of sale will affect your statutory rights or in any way exclude or limit our liability to you for death or personal injury resulting from our negligence.
